Legal Disclaimer & Freight Liability Limitations
1. 3PL Receiving Terminal vs. Originating Common Carrier
Pantheon Moving LLC d/b/a Pantheon Logistics acts as a commercial 3PL receiving terminal, cross-dock facility, and local white-glove delivery contractor. Pantheon is not the originating long-haul interstate motor carrier for third-party LTL or truckload freight consigned to our dock (e.g., shipments delivered by Estes Express, Old Dominion Freight Line, FedEx Freight, R+L Carriers, Saia, or TForce).
Under statutory transport regulations (including the Interstate Commerce Commission Termination Act and the Carmack Amendment), the originating line-haul carrier remains strictly liable for transit damage, loss, or shortages occurring while cargo was in their custody and control prior to dock receipt execution.
Our 24-Hour Digital OS&D inspection report serves as documentary evidence of freight condition upon intake. Shippers and design firms must file formal cargo claims directly with the originating motor carrier within that carrier’s statutory filing window.
2. Pre-Existing Defects, Inherent Vice & Manufacturer Packaging
Pantheon accepts no financial or legal liability for damages arising from the following circumstances:
- Inherent Vice of Goods: Natural expansion, contraction, splitting, checking, or warping of raw hardwood; internal micro-fractures or natural fissures in solid marble, travertine, quartz, or onyx; fabric shading, mohair crushing, or dye lot variations resulting from ambient atmospheric changes.
- Factory Defects & Inadequate Packaging: Missing assembly hardware, pre-stripped screw threads, defective welds, internal mechanism failure within sealed electronic/motorized furniture, or transit scuffing resulting from original manufacturer cartons packaged without adequate foam protection.
- Concealed Pre-Existing Damage: Internal damage discovered in unopened, manufacturer-sealed cartons where the exterior corrugated container exhibits no crushing, punctures, or transit impact marks.
3. Force Majeure & Extreme Midwest Weather Conditions
Logistics operations in the Greater Kansas City metropolitan area and surrounding freight corridors (I-35, I-70, I-29, I-435) are subject to severe continental weather events. Pantheon shall be excused from performance obligations, pickup deadlines, dock receiving appointments, and scheduled delivery arrival windows to the extent performance is prevented, delayed, or hindered by:
- Tornado warnings, severe microbursts, or high wind shears requiring ground stop procedures.
- Freezing rain, black ice, blizzards, or heavy snow causing Missouri Department of Transportation (MoDOT) or Kansas Department of Transportation (KDOT) highway travel advisories or commercial vehicle bans.
- Missouri River and Kaw River flood events causing closures of regional bridge crossings (e.g., Broadway Bridge, Bond Bridge, Heart of America Bridge).
- Regional electrical grid failure, utility interruptions, civil emergency declarations, or government requisition orders.
4. Building Premises, Elevator Access & Certificate of Insurance (COI)
Pantheon maintains comprehensive commercial general liability insurance ($2,000,000 aggregate) and workers' compensation coverage for all 100% W-2 crew members. However, client premises protection is subject to the following express conditions:
- Pre-Existing Property Conditions: Commercial property managers, designers, or homeowners must inspect lobby floors, elevator cabs, and corridor walls prior to crew arrival. Pantheon is not liable for pre-existing scratches, floor scuffs, or wall chips not documented prior to offload.
- Elevator & Loading Bay Reservations: Client is responsible for securing exclusive freight elevator reservations and dock bay clearance. Demurrage and crew standby rates apply if delivery crews are delayed by unreserved or malfunctioning elevator systems.
- Certificate of Insurance (COI) Requests: Custom COIs naming building management as additional insured must be requested at least twenty-four (24) business hours prior to dispatch.
5. Non-Binding Website Content & Quotations
All information, specifications, photos, rate guides, blog articles, and interactive chatbot responses provided on this website are for informational and planning purposes only. They do not constitute binding freight contracts, tariff schedules, or guaranteed delivery commitments.
Binding commercial logistics agreements are established exclusively through executed Service Level Agreements (SLAs), formal written Rate Confirmations, and signed warehouse receiving receipts issued by an authorized representative of Pantheon Moving LLC.
